Ohio’s existing laws around hemp regulation focus primarily on the cultivation and processing of hemp products, defined as those containing 0.3% or less of delta-9 THC. Hemp is traditionally used for a variety of non-intoxicating purposes, such as paper, textiles, and personal care products. However, since the passage of the 2018 Farm Bill, some processors have utilized chemical processes to convert hemp-derived cannabidiol (CBD) into delta-8 THC and other THC isomers. These compounds, while technically classified as hemp, are not regulated under current state law and can produce intoxicating effects like marijuana, making them psychoactive products under federal hemp guidelines.
Jodi Salvo, Empower Tusc Coalition Coordinator stated, “Many of these products are being sold over the counter at gas stations, convenience stores, etc. These products are fully accessible to youth in our communities and are perceived as harmless or safe. These products are sold without oversight or regulation which exacerbates the risk to public health and safety, especially for our young people.
On November 6th, Senator Steve Huffman (R-Tipp City) introduced Senate Bill 326, aimed at prohibiting the sale of intoxicating hemp products in Ohio.
The bill defines “intoxicating hemp products” based on their THC content, including delta-9 THC and other forms of non-delta-9 THC. This ensures that products with psychoactive effects are restricted, in line with the original intent of Ohio’s hemp laws.
The bill establishes clear penalties for anyone caught selling intoxicating hemp products in violation of the law. These penalties include both criminal charges and administrative fines. Importantly, the law also includes specific provisions for selling such products to individuals under twenty-one (21), emphasizing the protection of minors.
The Empower Tusc Coalition supports the passage of this legislation to protect Tuscarawas County youth and encourages that the public contact their state legislators to support this important bill.
